Terms of Service

The short version

Break Glass stores documents and information you choose, and delivers them to people you choose if you die or become incapacitated. We are not a law firm, we do not write your will, and we cannot guarantee delivery. Please read the rest — especially “What can go wrong”.

1. What the service does

You store documents, credentials, letters, and instructions in an encrypted vault. You nominate recipients (who receive what you designate) and verifiers (who are asked to confirm your status). You check in on a schedule you set. If you stop checking in, we contact your verifiers, and if enough of them confirm you have died or become incapacitated, we deliver what you left to your recipients.

2. We are not a law firm

Break Glass does not provide legal advice and does not create, validate, execute, or witness any legal document. Storing a will here does not make it valid. A will’s validity depends on the law where you live and usually requires a properly signed and witnessed original document. A power of attorney generally ends at death. Consult an estate attorney. We deliver copies and information; we do not create legal effect.

3. Your responsibilities

  • Keep your account credentials and two-factor recovery codes safe.
  • Keep your contacts’ email addresses and phone numbers current.
  • Respond to check-ins, or your switch will escalate as you configured it.
  • Only store information you have the right to store and share. Sharing account credentials may breach the terms of service of those accounts; where a provider offers its own legacy tool, we encourage you to use it as well.
  • Do not use the service to store anything unlawful.

4. What can go wrong

This is the section that matters most, and we would rather over-explain it than have you discover it later.

  • We may fail to deliver. Email can bounce or be filtered, phone numbers change, carriers block messages, and services suffer outages. We design against this — multiple channels, delivery confirmation, retries, and alerts — but we cannot guarantee that any message arrives.
  • We may deliver when we should not. Release requires your nominated verifiers to confirm your status. If they are mistaken, or act maliciously, your information may be released while you are alive. You choose your verifiers and how many must agree; choosing more than one materially reduces this risk.
  • Encryption keys can be lost. Your vault is encrypted. If our encryption key material is destroyed, the contents cannot be recovered by us or by anyone. Keep signed originals of important documents somewhere physical, and tell your people where.
  • Once released, it cannot be recalled. Delivered links, messages, and downloaded files are in your recipients’ possession permanently.

Break Glass must not be your only plan. It is a way to make sure the right people can find what you left them — not a replacement for a properly executed estate plan.

5. Availability, changes, and termination

We may change or discontinue the service. If we discontinue it, we will make reasonable efforts to notify you in advance and give you time to export your vault. You may delete your account at any time; deletion is permanent and removes your vault, contacts, and history. Deleting after a release has already occurred does not recall what was delivered.

6. Fees

Any fees will be stated clearly before you are charged. If your account lapses for non-payment, we will notify you before disabling the switch, because a switch that silently stops is the worst possible outcome.

7. Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, Break Glass is not liable for indirect, incidental, consequential, special, or punitive damages, or for any loss arising from a failure to deliver, a premature delivery, or the unavailability of the service. Our total aggregate liability is limited to the greater of the fees you paid us in the twelve months preceding the claim, or USD 100. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.

8. Governing law

These terms are governed by the laws of the State of [STATE], without regard to conflict of laws principles.
